This contract provided the State with complete construction inspection and contract administration services for the highway improvement project; State Project 8707-51. The construction of the project was funded in part by the American Recovery and Reinvestment Act and in part by the Upper Sioux Community (tribal government). In partnership with the Upper Sioux Community, the State agreed to provide construction engineering for the work. Due to the unique funding opportunity, the project was largely unexpected, and the State was not able to staff it through normal District resources.

The Contractor completed the work on time.
The quality of the work was satisfactory.
The Contractor’s cost was fair/market value.
The Contractor performed the contracted tasks even though there were many nontraditional elements and events associated with this contract. The construction contract was for the Upper Sioux Community and not all of MnDOT’s traditional practices were needed. In addition, tribal allowances posed the need to improvise and document some things differently. The State government shutdown occurred as this contract was about to get underway. This caused some unknowns in the contract administration of this project until the shutdown ended and the construction contractor was able to schedule the work. Yaggy Colby did a good job of adapting to these situations.
