State often acquires right-of-way to build transportation systems. To minimize long and short term environmental liability from contaminated soil and groundwater on properties to be acquired, State must complete environmental due diligence on those properties to receive liability assurances from the appropriate regulatory agency. Additionally, State encounters contaminated soil and groundwater on those properties which requires specific management during construction. State seeks to obtain regulatory closure for those contaminated soil and groundwater management actions. These actions increase the ability of State to manage environmental risks and obtain the best liability protection possible
