A current operating permit defines the regulatory profile for the facility and establishes the best record for compliance demonstration. A current operating permit also provides a solid platform upon which a permit amendment can be issued in a more expeditious and thorough manner. Several facilities have proposed to assume enforceable emission and operating limits adequate to avoid Part 70 requirements (i.e. state operating permits), while others facilities’ emissions are over certain thresholds, subjecting them to those requirements (i.e. federal operating permits). Facilities with plans to expand or modify must first obtain a construction-related permit amendment from the MPCA. For the same reasons mentioned above, these will be either state or federal construction-related amendments.
